When possible, our team works to avoid litigation through negotiation and the pre-suit process, and when litigation is required, our attorneys are ready to represent our clients having successfully represented clients through creative and successful mediation, dispositive motion practice, and trial. Construction litigation matters handled by the firm include construction defect litigation, contract disputes, Florida Building Code Violation claims, delay claims, product liability, lien disputes, professional negligence, licensing disputes, and insurance coverage litigation.
In addition, our attorneys counsel clients through transactions, such as assisting in negotiation of contracts.
ALTERNATIVE DISPUTE RESOLUTION
Alternative Dispute Resolution processes provide methods to resolve disputes outside of the Courtroom and without the Courts. These processes include arbitration, non-binding arbitration, mediation, and informal settlement conferences. Our attorneys represent clients in alternative dispute resolution both before and during litigation. Once in litigation, most of the time, the Courts require to engage in mediation, and in some instances, the court may require or the parties may agree to participate in non-binding arbitration.
Mediation is a core part of the firm’s practice, and our team includes Jeff Katz, a certified mediator. The attorneys pride themselves on walking our clients through the mediation and alternative dispute resolution process while working creatively to favorably resolve claims. Our attorneys have experience in multiple arbitration forums, including arbitration in AAA and JAMS, and are familiar with the rules of the diverse arbitration forums.
